NRC board denies Vermont Yankee opposition
ROCKVILLE, Md., March 1 -- An NRC Atomic Safety and Licensing Board nixed a petition urging an experiment at Vermont Yankee. New England Coalition wanted the plant to prove, by conducting an emergency shutdown, that the backup and safety systems of the plant could handle a real emergency. The Board ruled that such an experiment wasn't necessary. NRC officials say there are no more legal challenges to Vermont Yankee power uprate application, although the New England Coalition may appeal the board's ruling the entire commission. *
Brattleboro moves to give manager walking papers
Brattleboro's Town Manager Jerry Remillard is stepping down. Remillard had worked his way up through the ranks of the town's Public Works Department before being appointed director and then, a decade ago, town manager. He has been in the hot seat on issues ranging from how well the town is prepared for an emergency at the nearby Vermont Yankee nuclear plant to a fatal 2001 police shooting of a man in a church. Last year, town officials couldn't find the contract they said they had signed with the company hired to manage a new transit center project. Remillard went on leave in December in the midst of two investigations into the project. Reviews by the state auditor of accounts and the Federal Transit Administration found there had been no wrongdoing by Remillard or other town officials, but that the project could have been managed better. The Select Board voted 4-1 Wednesday to authorize Chairman Stephen Steidle to sign off on a separation agreement with Remillard. February 27, 2007 Massachusetts Attorney General is confused if it thinks it might still be a party to Pilgrim or VY license renewal case, sez NRC staff In January 2006, the Massachusetts Attorney General (MassAG) filed petitions to intervene in license renewal proceedings for Pilgrim and Vermont Yankee. MassAG contended at the time that alleged new information about spent fuel pool fires should be considered in the proceedings. Both ASLBs rejected MassAG's contention, and NRC affirmed those decisions. MassAG wants NRC to reconsider and clarify that affirmation. NRC staff urges the Commission to make it clear to MassAG that the decision to affirm the ASLBs was final and will not be reconsidered. March 3, 2006 Vermont Yankee 20% uprate approved by NRC, and plant is ready to ramp up immediately; now come battles over license renewal and ISFSI Vermont Yankee will start generating additional power within the next few days - and, if all goes well, reach its new output level of roughly 640 megawatts within a few weeks, a plant spokesman said. The plant has been preparing for the uprate for the past two years. The plant installed a new high-pressure turbine and new feedwater heaters and rebuilt the electrical generator. During last fall's refueling outage the utility loaded a core that could generate the additional 100 megawatts of power as soon as approval came - without having to go through a shutdown. In announcing the approval Thursday, the NRC said the review was the most extensive ever done by the NRC in the more than 100 uprate applications. "The staff at headquarters, our Region 1 office in Pennsylvania and the resident inspectors at the plant have thoroughly examined this uprate request," said Jim Dyer, director of the NRC's office of nuclear reactor regulation. "We've taken great care to identify and address technical concerns with safely operating the plant at increased power." The review took more than two years and more than 11,000 staff-hours, the NRC said, adding that a related engineering inspection required another 900 hours of work. Raymond Shadis of the anti-nuclear New England Coalition dismissed the statistics as meaningless. "Two years. So what?" he said. "That is just a tribute to the bureaucracy; they are talking about a two-year paper chase, they are talking about 11,000 hours of sharpening pencils, 11,000 hours of going to the water cooler, 11,000 hours of putting on public relations events. The process has been a fraud and a sham demonstrating that the NRC will do whatever it takes to accommodate the nuclear industry." Vermont Yankee was built by a consortium of New England utilities and was sold to Entergy in 2002. The company is seeking to extend Vermont Yankee's operating license 20 years past its current expiration of 2012. The NRC says the license review will take roughly 30 months. In addition, the plant is asking the state for permission to store its nuclear waste in concrete and steel casks on its grounds. This move is crucial to the plant's continued operations because operating at the increased power means it will use more fuel rods and will run out of room in its existing fuel pool. The state government has a revenue-sharing agreement related to the 20% uprate which is expected to bring the state more than $20 million, according to Vermont Yankee spokesperson Rob Williams. Entergy spokesman Robert Williams said the fire, which was discovered at about 6:50 a.m., was put out by fire departments from three surrounding towns, as well as Vermont Yankee's own fire brigade, by 7:17 a.m. The fire did not affect the nuclear side of the plant, a company official said. The transformer was only two years old, having been purchased from a manufacturer in Scotland for $4.5-million, in preparation for Entergy's desire to increase power production. Williams said he didn't know whether the plant had a backup transformer. Sherman said that the transformer removed in 2002 was still at the Vernon reactor. Raymond Shadis, the staff technical advisor for the New England Coalition, said he had shared the information he had with Arnold Gundersen, a nuclear engineer who has been helping him on technical issues, and they theorized, based on an informant's description of arcing, sparking and explosion before the fire, that recent controls installed on the switchyard for the proposed increase in power failed. "This company either has very, very, very, very poor management or it's very, very, very, very unlucky," Shadis said, referring to the string of problems that has surfaced at Vermont Yankee in recent months. Ready] report recommended the state's nuclear preparedness spending triple from $400,000 to $1.2 million, Dean budgeted only half the increase. That led Dean's state emergency management director, Ed von Turkovich, to tell the Legislature in 2002 that the increase to $800,000 "does not cover the expenses related to the program" and that Vermont's nuclear preparedness was "in trouble, grossly underfunded, under-resourced and has been for years." Dean's campaign said the governor spent significant other money on security through other departments. The lack of preparedness was blamed in the 2002 audit on inadequate funds. "We are sympathetic to the utility's concern for controlling costs with respect to the pending sale of the plant and have committed to expend additional state and federal resources to subsidize this program in the coming year," von Turkovich wrote. "However, I believe in the near future, the present or new owners will need to broaden their level of support for preparedness activities that need to be accomplished on behalf of the communities that reside in the Emergency Planning Zone," he wrote. A group of students "on a tour were taken into a secure area without checking through security first," the aide wrote, saying the matter was minor but would be disclosed to federal regulators. Richard Sedano, Dean's top utility regulator, said Saturday that while "everybody has a different appreciation of terrorism after the World Trade Center" the state closely monitored Vermont Yankee's safety and in May 1993 staged a public hearing to embarrass the plant's operators into improving their management. Windham Regional Commission will hold pubic meeting on Monday, April 21, featuring debate on the uprate between representatives of the plant and the Brattleboro-based New England Coalition. Members of the public will be able to question the debators, and public comments to the Commission will close out the meeting.
Local newspaper reporter previewed some of the arguments that New England Coalition spokesman Raymond Shadis is considering: April 15: Last week's emergency exercise was discussed today at meeting between the plant and various government organizations. The formal written reports on such exercises from NRC and FEMA are typically released within thirty and ninety days, respectively. An AP article included some comments from participants: Dan McElhinney, director of national preparedness for FEMA in Boston, said that despite the areas of concern the overall performance was positive. "I do not find anything at this point (warranting) a finding of deficiency," he said. McElhinney said the problems ranged from erroneous information being sent out by state officials to lack of adequate telephones and failing to plot the path of radioactivity coming from the nuclear reactor. Duncan Higgins, deputy director of the Vermont Office of Emergency Management, said he was pleased that the state had corrected problems discovered in the last drill. NRC Inspector Beth Sienel said "Overall, our preliminary findings show that the licensee was able to adequately protect the public health and safety." The approach used in previous years relied partly on property tax based on annual value reported to federal regulators (FERC). Such reporting is no longer required of the plant, due to change in ownership last summer when Entergy bought it. The plant last year paid $4.5-million in state taxes, and Senate Finance Committee members told AP reporter that they're aiming to have the plant continue to pay at least that much every year. A bill in the House, developed in consultation with the plant and state Tax Department, would tax the amount of electricity generated. Vermont Yankee, the town of Vernon, the Windham Regional Commission, the state Department of Public Service and Agency of Natural Resources, and the New England Coalition have the right to participate in the case by pre-filing testimony and cross-examining witnesses under oath before the board.
