* Vermont Yankee is located in Vernon -- in the southeastern corner of the state, where the state borders New Hampshire and Massachusetts. ROCKVILLE, Md., March 1 -- An NRC Atomic Safety and Licensing Board nixed a petition urging an experiment at Vermont Yankee. New England Coalition wanted the plant to prove, by conducting an emergency shutdown, that the backup and safety systems of the plant could handle a real emergency. The Board ruled that such an experiment wasn't necessary. NRC officials say there are no more legal challenges to Vermont Yankee power uprate application, although the New England Coalition may appeal the board's ruling the entire commission.

Brattleboro's Town Manager Jerry Remillard is stepping down. Remillard had worked his way up through the ranks of the town's Public Works Department before being appointed director and then, a decade ago, town manager. He has been in the hot seat on issues ranging from how well the town is prepared for an emergency at the nearby Vermont Yankee nuclear plant to a fatal 2001 police shooting of a man in a church. Last year, town officials couldn't find the contract they said they had signed with the company hired to manage a new transit center project. Remillard went on leave in December in the midst of two investigations into the project. Reviews by the state auditor of accounts and the Federal Transit Administration found there had been no wrongdoing by Remillard or other town officials, but that the project could have been managed better. The Select Board voted 4-1 Wednesday to authorize Chairman Stephen Steidle to sign off on a separation agreement with Remillard.

Massachusetts Attorney General is confused if it thinks it might still be a party to Pilgrim or VY license renewal case, sez NRC staff

In January 2006, the Massachusetts Attorney General (MassAG) filed petitions to intervene in license renewal proceedings for Pilgrim and Vermont Yankee. MassAG contended at the time that alleged new information about spent fuel pool fires should be considered in the proceedings. Both ASLBs rejected MassAG's contention, and NRC affirmed those decisions. MassAG wants NRC to reconsider and clarify that affirmation. NRC staff urges the Commission to make it clear to MassAG that the decision to affirm the ASLBs was final and will not be reconsidered. Vermont Yankee 20% uprate approved by NRC, and plant is ready to ramp up immediately; now come battles over license renewal and ISFSI

Vermont Yankee will start generating additional power within the next few days - and, if all goes well, reach its new output level of roughly 640 megawatts within a few weeks, a plant spokesman said. The plant has been preparing for the uprate for the past two years. The plant installed a new high-pressure turbine and new feedwater heaters and rebuilt the electrical generator. During last fall's refueling outage the utility loaded a core that could generate the additional 100 megawatts of power as soon as approval came - without having to go through a shutdown.

In announcing the approval Thursday, the NRC said the review was the most extensive ever done by the NRC in the more than 100 uprate applications. "The staff at headquarters, our Region 1 office in Pennsylvania and the resident inspectors at the plant have thoroughly examined this uprate request," said Jim Dyer, director of the NRC's office of nuclear reactor regulation. "We've taken great care to identify and address technical concerns with safely operating the plant at increased power." The review took more than two years and more than 11,000 staff-hours, the NRC said, adding that a related engineering inspection required another 900 hours of work. Raymond Shadis of the anti-nuclear New England Coalition dismissed the statistics as meaningless. "Two years. So what?" he said. "That is just a tribute to the bureaucracy; they are talking about a two-year paper chase, they are talking about 11,000 hours of sharpening pencils, 11,000 hours of going to the water cooler, 11,000 hours of putting on public relations events. The process has been a fraud and a sham demonstrating that the NRC will do whatever it takes to accommodate the nuclear industry."

Vermont Yankee was built by a consortium of New England utilities and was sold to Entergy in 2002. The company is seeking to extend Vermont Yankee's operating license 20 years past its current expiration of 2012. The NRC says the license review will take roughly 30 months. In addition, the plant is asking the state for permission to store its nuclear waste in concrete and steel casks on its grounds. This move is crucial to the plant's continued operations because operating at the increased power means it will use more fuel rods and will run out of room in its existing fuel pool. The state government has a revenue-sharing agreement related to the 20% uprate which is expected to bring the state more than $20 million, according to Vermont Yankee spokesperson Rob Williams.

Vermont Yankee down for a week due to switchyard fire

William Sherman, the state's nuclear engineer, estimated that Vermont Yankee would be shut down for at least a week for repairs, following a spectacular transformer fire Friday that sent flames shooting 30 feet into the air, as well as a giant column of black smoke. Entergy spokesman Robert Williams said the fire, which was discovered at about 6:50 a.m., was put out by fire departments from three surrounding towns, as well as Vermont Yankee's own fire brigade, by 7:17 a.m. The fire did not affect the nuclear side of the plant, a company official said. The transformer was only two years old, having been purchased from a manufacturer in Scotland for $4.5-million, in preparation for Entergy's desire to increase power production. Williams said he didn't know whether the plant had a backup transformer. Sherman said that the transformer removed in 2002 was still at the Vernon reactor. Raymond Shadis, the staff technical advisor for the New England Coalition, said he had shared the information he had with Arnold Gundersen, a nuclear engineer who has been helping him on technical issues, and they theorized, based on an informant's description of arcing, sparking and explosion before the fire, that recent controls installed on the switchyard for the proposed increase in power failed. "This company either has very, very, very, very poor management or it's very, very, very, very unlucky," Shadis said, referring to the string of problems that has surfaced at Vermont Yankee in recent months. "Either way, it's not comforting to the public."

Vermont Yankee - NRC will use new engineering inspection process

The Massachusetts Town of Gill, via letter from their Board of Selectmen, urged NRC to conduct an independent safety assessment of Vermont Yankee prior to licensing a 20-percent power uprate. Cornelius F. Holden, an official with NRC's Office of Nuclear Reactor Regulation, replied that NRC's May 4, 2004 letter to the Vermont Public Service Board "describes our plans to use an improved engineering inspection at Vermont Yankee. The NRC staff has concluded that the detailed technical review, combined with inspections prescribed by the reactor oversight process, as enhanced by a new engineering inspection, is the most effective method of determining whether Vermont Yankee could safely operate under uprated power conditions." In a letter dated May 4, 2004, the NRC Chairman responsed to a request by the Vermont Public Service Board (PSB) that the NRC conduct an independent engineering assessment at Vermont Yankee as part of its review of the pending power uprate application. The response states that the NRC has decided to conduct a detailed engineering inspection that will be appropriate for addressing NRCÕs oversight responsibilities and is also responsive to the PSBÕs concerns. Subsequent to receipt of the PSB request, the NRC received numerous letters from Congressmen, local officials, and members of the public in support of an independent assessment. The NRC Chairman also responded to letters from interested Congressional stakeholders on May 4, 2004. Responses to the remaining letters are being developed.

Vermont Yankee security - examples of the $8-million in recent upgrades

"Most of the things mentioned in the [AP] article [on VY security] are 10 to 12 years old," plant spokesperson Rob Williams said Sunday. The article is drumming up old fears that were allayed years ago, he said. "Ninety percent of it is a rehash of issues that have been fully addressed over the past decade," he said. "As far as Vermont Yankee is concerned, we've spent $8 million in upgrades since then." Williams said the plant has since instituted new security measures that include additional perimeter fencing, a state-of-the-art intrusion detection system, closed-circuit video surveillance, reinforced guard towers, concrete vehicle barriers, explosive detection devices and enhanced guard weaponry. "We're also more integrated with the Office of Homeland Security and all levels of law enforcement," he said. "With those improvements, we have the most highly protected facility in that part of the nation's infrastructure." Yankee meets all the requirements set by the U.S. Nuclear Regulatory Commission and is continuing to make improvements to ensure the plant's safety from potential attacks, Williams said.

Vermont Yankee security is ready for those who might consider breach, sez state police official

Capt. William Sheets of the state[ of Vermont]'s Homeland Security Unit issued a statement Sunday afternoon defending the security and safety of the plant. "It is critically important that all Vermonters be aware of the robust security program currently in place at Vermont Yankee," he stated. "Those considering even the slightest breach of security will be subjected to immediate arrest and federal prosecution."

At least one rival campaign cited it to question Dean's ability to be a strong commander-in-chief... Senator John F. "FEMA staffers have sought to soothe the public by saying the problems are not serious and do not present health and safety risks," Ready said. "I disagree."

Vermont Yankee - Dean administration's underwhelming record in security, emergency planning during 1991-2002

Presidential hopeful Howard Dean, who accuses President Bush of being weak on homeland security, was warned repeatedly as Vermont governor about security lapses at his state's nuclear power plant and was told the state was ill-prepared for a disaster at its most attractive terrorist target.

The warnings, according to documents obtained by The Associated Press, began in 1991... Security was so lax at Vermont Yankee that [after an] August 2001 ... drill..., [t]he Nuclear Regulatory Commission gave Vermont Yankee the worst security rating among the nation's 103 reactors.

... The NRC has primary responsibility for safety at Vermont Yankee. But Vermont laws required an active state role by creating a panel to review security and performance and requiring plant operators to set aside money for the state to use in the event of a nuclear disaster.

... During Dean's final year in office in 2002, an audit concluded that despite a decade of repeated warnings of poor safety at Vermont Yankee, Dean's administration was poorly prepared for a nuclear disaster.

"The lack of funding and overarching coordination at the state level directly impacts the ability of the state, local and power plant planners to be adequately prepared for a real emergency at Vermont Yankee," state Auditor Elizabeth M. Ready wrote in a study issued five months after the Sept. 11 attacks.

... Ready's audit in 2002 questioned why, with so many warnings about safety, Dean's administration had significantly fewer people committed to nuclear emergency planning than neighboring states. "Unlike its nearest counterparts, Vermont's Division of Emergency Management has only one full-time and two part-time staff to support" its emergency response program, she wrote. "New Hampshire has nearly 20 full- and part-time staff as well as consultants, while Massachusetts has more than 20 full-time staff to carry out" its program.

... The documents contrast with Dean's position as a presidential candidate who has portrayed himself as more concerned about nuclear security than Bush.

"Our most important challenge will be to address the most dangerous threat of all: catastrophic terrorism using weapons of mass destruction," Dean said in his speech in Los Angeles last month. "Here, where the stakes are highest, the current administration has, remarkably, done the least."

Vermont Yankee - Dean improved state focus after 2002 audit report

"After September 11, Governor Dean decided the buck stops here in terms of security and personally ran this effort, creating a Cabinet-level agency," spokesman Jay Carson said.

Carson acknowledged there were weaknesses before 2002 in Vermont's nuclear preparedness, and Dean moved quickly afterward to place state troopers and National Guardsman at the plant, distribute radiation pills to civilians, demand a federal no-fly zone over the plant to prevent an aerial attack, and increase emergency preparedness funding.

"As many have said before, hindsight is 20-20 and no one could have predicted what could have happened on a terrible day in September 2001," Carson said.

"In retrospect, every state in the entire country could have been safer. The important thing is after Governor Dean recognized these vulnerabilities, he took swift, bold steps to make things better," Carson said.

State Auditor Ready, a Democrat and Dean backer, agreed things improved after her critical 2002 report and that security tests this year showed Vermont Yankee was safer. "Once Governor Dean got that report there was swift and thorough action," she said.

Vermont Yankee - state emergency preparedness budget, even after 2002 increase, was underfunded

But even after Ready's [State Auditor Elizabeth M. Ready] report recommended the state's nuclear preparedness spending triple from $400,000 to $1.2 million, Dean budgeted only half the increase.

That led Dean's state emergency management director, Ed von Turkovich, to tell the Legislature in 2002 that the increase to $800,000 "does not cover the expenses related to the program" and that Vermont's nuclear preparedness was "in trouble, grossly underfunded, under-resourced and has been for years." Dean's campaign said the governor spent significant other money on security through other departments.

The lack of preparedness was blamed in the 2002 audit on inadequate funds. "Vermont receives the least amount of funding for its Radiological Emergency Response Plan, in total dollars, of any New England state that hosts a nuclear power plant," the audit disclosed.

The audit was not the first warning to Dean, documents show.

On Feb. 14, 2000, von Turkovich wrote Dean's top deputy, Administration Secretary Kathleen Hoyt, expressing concern the state was not forcing Vermont Yankee, which was up for sale, to set aside more money for preparedness.

"We are sympathetic to the utility's concern for controlling costs with respect to the pending sale of the plant and have committed to expend additional state and federal resources to subsidize this program in the coming year," von Turkovich wrote.

"However, I believe in the near future, the present or new owners will need to broaden their level of support for preparedness activities that need to be accomplished on behalf of the communities that reside in the Emergency Planning Zone," he wrote.

Vermont Yankee - 1991 security event reviewed by Dean at the time

In August 1991, an aide sent a handwritten memo to Dean saying there was a "security error" at Vermont Yankee that was "not public." A group of students "on a tour were taken into a secure area without checking through security first," the aide wrote, saying the matter was minor but would be disclosed to federal regulators. Dean initialed the memo, indicating he read it.

Vermont Yankee - 1992-93 state involvement in encouraging improvement

In 1992, the NRC provided information to Dean about "declining performances at Vermont Yankee in three important areas: plant security, engineering/technical support and safety assessment/quality verification," documents show.

Dean responded by writing the head of the plant that the problems could "have an impact on the health and safety of the people of Vermont" and "it is my expectation that you will do all in your power to correct this declining trend." It was one of several such letters he wrote.

Just months later, the Vermont Nuclear Advisory Panel, a state panel, reported that two nuclear fuel mishandling incidents at the plant were the "result of complacent operator and management actions."

Richard Sedano, Dean's top utility regulator, said Saturday that while "everybody has a different appreciation of terrorism after the World Trade Center" the state closely monitored Vermont Yankee's safety and in May 1993 staged a public hearing to embarrass the plant's operators into improving their management. He called it a "therapeutic and beneficial experience."

Environmental groups sent Dean repeated letters about the plant's security and safety.

April 19, 2003: Connecticut River Watershed Council has been added to list of parties in the state Public Service Board consideration of 20% power uprate. Windham Regional Commission will hold pubic meeting on Monday, April 21, featuring debate on the uprate between representatives of the plant and the Brattleboro-based New England Coalition. Members of the public will be able to question the debators, and public comments to the Commission will close out the meeting. Local newspaper reporter previewed some of the arguments that New England Coalition spokesman Raymond Shadis is considering:
(1) Adverse effects on reactor safety ["In an Oct. 17, 2001, letter to then-NRC chairman Richard Meserve, a senior NRC official warned that a 20 percent uprate proposal -- 'the largest power uprate ever considered for boiling water reactors in the United States' -- would increase the chance of a meltdown. VY is a boiling water reactor. 'Though we persuaded ourselves eventually that the Duane Arnold Energy Center (nuclear plant in Iowa) power uprate could be accomplished safely, we found it difficult to obtain information on the technical resolution of the issues either in the staff's safety evaluation report or in our meetings with the staff,' wrote George Apostolakis, chairman of the NRC's Advisory Committee on Reactor Safeguards. Confirming Apostolakis's fears, the Quad Cities nuclear power plant in Illinois was forced to temporarily shut down due to a safety problem in June 2002, shortly after it increased its power output by 18 percent, according to an NRC report. 'Licensees should be aware of similar unanticipated effects from increased flow, power, or differential pressure associated with a major modification such as an extended power uprate,' the report, dated Sept. 11, 2002, concluded."] The newspaper article quotes ENVY spokesperson Robert Williams as saying that "There will be no change in the safety limits required, and no increase in reactor temperature, pressure and turbine speed. It's a routine, standard procedure. Most plants have done some level of uprate, and some have done 20 percent uprates."

(3) Increased impact on the Connecticut River [The state Dept of Natural Resources "will hold a public hearing in the Brattleboro area, at a date to be determined, before it issues a wastewater discharge permit for the project... But even if the agency refuses to grant Entergy a permit, the company will still proceed with the uprate, according to a letter to the Public Service Board from Entergy lawyer Victoria Brown. The power upgrade can be accomplished without increasing discharge into the river, by 'increased use of the cooling towers and therefore a slight increase (less than 1.5 percent of stream flow) in evaporative water loss,' Brown wrote. David Lochbaum, a nuclear engineer with the Union of Concerned Scientists in Washington, said Vermont Yankee takes approximately 19 million gallons of water a day out of the Connecticut River during the summer, and less in the winter. It heats, adds chemicals, and dumps back into the river approximately 5 million gallons. The rest is released into the air, with radioactive particles, through VY's chimney, Shadis said."]
(4) Increased chance that owner won't shut down the plant as soon ["'Vermont Yankee obviously wasn't highly profitable for the companies that Entergy bought VY from last summer or they wouldn't have sold it,' Shadis said. 'If Entergy doesn't get this uprate, they may close the plant because it isn't profitable enough,' he speculated."]
(5) Increased global warming from extra fuel use ["Contrary to popular belief, the generation of electricity by Vermont Yankee does contribute to global warming through the burning of fossil fuels for the mining, processing and shipping of its radioactive fuel, Shadis said. That contribution would be increased if the uprate is approved, he said."]

April 15: Last week's emergency exercise was discussed today at meeting between the plant and various government organizations. The formal written reports on such exercises from NRC and FEMA are typically released within thirty and ninety days, respectively. An AP article included some comments from participants: Dan McElhinney, director of national preparedness for FEMA in Boston, said that despite the areas of concern the overall performance was positive. "I do not find anything at this point (warranting) a finding of deficiency," he said. McElhinney said the problems ranged from erroneous information being sent out by state officials to lack of adequate telephones and failing to plot the path of radioactivity coming from the nuclear reactor. Duncan Higgins, deputy director of the Vermont Office of Emergency Management, said he was pleased that the state had corrected problems discovered in the last drill. NRC Inspector Beth Sienel said "Overall, our preliminary findings show that the licensee was able to adequately protect the public health and safety." April 8: The Vermont state legislature is considering how best to tax Vermont Yankee. The approach used in previous years relied partly on property tax based on annual value reported to federal regulators (FERC). Such reporting is no longer required of the plant, due to change in ownership last summer when Entergy bought it. The plant last year paid $4.5-million in state taxes, and Senate Finance Committee members told AP reporter that they're aiming to have the plant continue to pay at least that much every year. A bill in the House, developed in consultation with the plant and state Tax Department, would tax the amount of electricity generated.
