* NRC: Mehta Has No Case At Millstone--Commission won't elaborate on how it reached its decision

Investigators for the Nuclear Regulatory Commission have found Dominion did not discriminate against whistleblower Sham Mehta of East Lyme. Mehta alleged last year that Dominion had retaliated against him by eliminating his job after he reported a security concern -- that the intruder alert system at Millstone was routinely turned off because of false alarms. As a worker in the Employee Concerns department, it was his job to report to management such issues. Neither Dominion Spokesman Pete Hyde nor Mehta's lawyer, Hank Murray, would comment on NRC's finding. NRC has been monitoring the outcome of a similar case pending before the U.S. Labor Department, which this week authorized a confidential settlement between the parties. Mehta has lodged a third complaint before the state Department of Public Utility Control, and that case is still pending. An interim finding has called for a full investigation and reinstated Mehta in a different job at Millstone pending the outcome of that case.

On November 9, 2005, NRC/OI (Region I Field Office, NRC Office of Investigations), initiated an investigation (Case No. 1-2006-004) to determine if a Millstone Senior Employee Concerns Program investigator was discriminated against for engaging in protected activities, including raising safety concerns regarding certain security equipment at Millstone. Based on testimonial and documentary evidence, OI concluded that there was insufficient evidence to substantiate discrimination against the investigator for engaging in protected activities, including raising safety concerns. However, the NRC is aware that the same investigatorŐs concerns are under review by the U. S. Department of Labor (DOL). Therefore, the NRC file on this case will remain open pending our receipt and review of the final DOL decision.
Final NRC documents, such as the OI report described above, may be made available to the public under the Freedom of Information Act (FOIA) subject to redaction of information appropriate under the FOIA. Requests under the FOIA should be made in accordance with 10 CFR 9.23, Requests for Records.

Millstone and strontium

Today's batch of documents released by NRC includes a March 2 letter from Nancy Burton of the Connecticut Coalition Against Millstone, which claims that "The data strongly suggests - and indeed does so almost to a certainty - that Dominion Nuclear Connecticut, Inc. is operating and will continue to operate the Millstone Nuclear Power Station in violation of NRC regulations requiring limiting doses to the public of 15 millirems per year to any organ." Attached to the letter is an affadavit-style declaration by U Pitt emeritus Prof. Ernest Sternglass discussing implications of an elevated strontium-90 result in a goat milk sample, and other information. The charges were reported back in March in Hartford Courant article titled "Coalition Disputes NRC Report Says Millstone Data Show Illegal Operations".

One of the points made by Dr. Sternglass tends to undermine the central claim. He rightly notes that strontium-90 would not be released in isolation, that other isotopes would be released along with it. Your humble nuclear.com editor agrees, and notes that cobalt-60 and cesium-137 would be be expected to be found at similarly unusual high levels if the strontium-90 reading was representative of plant operations.

Millstone-1 spent fuel pool cooling pumps lost power for about 2 hrs due to fire outside protected area

At approximately 6:45 a.m., Millstone Unit 1 lost power to the spent fuel pool pumps when a transient caused the Flanders Line main breaker to open and automatically re-close. Plant personnel observed smoke, some arcing, and small flames on a utility pole located outside the protected area. The spent fuel pool pumps were returned to service when power was restored at 8:59 am. NRC resident inspector reported that during this short period no significant increase in spent fuel pool temperature occurred. By the way, the time to boil for the Unit 1 spent fuel pool is in excess of several days.

* Nuclear reactor shut down to investigate problem

Millstone-3 shut itself down after detecting a problem yesterday morning, causing a release of non-radioactive steam into the air, a plant official said. A problem in the steam system was discovered at about 8:30 a.m. Some residents near the plant were concerned and called Millstone because the release of steam is not a usual event at the complex, Dominion Nuclear Connecticut spokesperson Pete Hyde said. Dominion declared an alert, the second lowest of four action levels in Millstone's emergency response plan, at about 8:42 a.m. The alert was canceled at about 7 p.m. There was no release of radioactive material and no one was injured, Hyde said. Millstone officials said Unit 3 would be shut down indefinitely while the problem is found and fixed.

Millstone-2&3 license renewal - petitions for hearing due by May 11

The current operating licenses for Unit 2 and Unit 3 expire on July 31, 2015, and November 25, 2025, respectively. NRC staff have determined that Dominion Nuclear Connecticut, Inc. has submitted sufficient information for the agency to formally "docket", or file, the applications. Docketing the applications does not preclude requesting additional information as the review proceeds, nor does it indicate whether the Commission will grant or deny the applications.

Millstone spent fuel - town zoning commission sez go slow

Millstone expects to eventually need more than 200 dry casks for onsite storage of spent fuel. The owner of the three Millstone units plans to apply this month to the Connecticut Siting Council for permission to build 135 bunkers. Meanwhile, local zoning officials in the town of Waterford have recommended limiting the plant, for the time being, to 19 bunkers and casks. "We need to keep this thing to a manageable level," Planning Director Thomas Wagner said in presenting a five-page draft of recommendations to commissioners. "If they can justify more, they can reapply." The state council can modify the local recommendation only if two-thirds of the state council members agree to an alternative.

The recommendations specify that the storage bunkers be used only for spent fuel from Millstone 2. Written status reports are required every five years on construction, bunker installation, continued need and other changes.

Zoning commissioners also said that Millstone's owner, Dominion Nuclear Connecticut, should provide "a good faith and detailed examination of alternatives" that the company rejected before choosing this type of storage facility. That includes a summary of the financial analysis that contributed to the decision.

The town of Waterford's conservation commission wants to see a groundwater and surface-water monitoring plan to annually assess whether any radionuclides or volatile organic compounds are released into water resources on site.
