The PFS facility still faces a number of regulatory obstacles before it can get its license. Several safety and environmental questions, including the risk of a jet fighter crashing into the facility, have yet to be resolved.

Still, Goshute Tribal Chairman Leon Bear was pleased by Thursday's ruling: "This decision brings us one step closer to the approval of a license and an opportunity for our people who will be able to participate in the construction and operation of the facility."
